This paper explores the idea of authenticity, both what it is and why it’s valuable. First, I identify and criticize three popular approaches to authenticity: Individual Authenticity, Natural Authenticity, and Truthful Authenticity. Second, I defend a fourth approach to authenticity – what I call Existential Authenticity (EA) – which is comprised of three basic elements: (a) self- understanding, (b) self-expression, and (c) self-concern – in particular, concern about what kind of person one is and what type of life one lead. *Runner-up for the 2021 Royal Institute for Philosophy Essay Prize*: What should we think about ‘acts of conscience’, viz., cases where our personal judgments and public authority come into conflict such that principled resistance to the latter seems necessary? Philosophers mainly debate two issues: the Accommodation Question, i.e., ‘When, if ever, should public authority accommodate claims of conscience?’ and the Justification Question, i.e., ‘When, if ever, are we justified in engaging in acts of conscience – and why?’. By contrast, a (...) third important topic – the Conduct Question, i.e., ‘How should we act, morally speaking, when engaging in acts of conscience?’ – has been mostly neglected. This paper aims to offer concrete guidance for persons wishing to engage in acts of conscience in morally virtuous ways. I argue that such agents are subject to two basic prima facie duties: duties to oneself related to demands of integrity and duties to others related to demands of civility. I explain both duties in detail, arguing with regard to, that in light of what I call ‘the paradox of conscience’, we need to rethink our views about both ‘conscience’ and ‘integrity’; and with regard to, that, building upon Rawls’ ‘duty of civility’, we should embrace at least seven general principles for undertaking acts of conscience in a morally conscientious manner. Most scholars describe Kant’s idea of dignity as what I term his “vertical” account—that is, our human dignity insofar as we rise above heteronomous natural inclinations and realize human freedom by obeying the moral law. In this paper, I attempt to supplement this traditional view by exploring Kant’s neglected “horizontal” account of dignity—that is, our human dignity insofar as we exist in relationship with others. First, I examine the negative aspect of this horizontal account of dignity, found in Kant’s discussion (...) of public heteronomy perpetuated by unjust social institutions. Second, I explore Kant’s idea of public dignity realized via social interaction: both (1) at the interpersonal level of education and friendship, and (2) at the societal level, in terms of moral education in the public sphere and a communal moral striving towards the highest good. I argue that we cannot realize our full human dignity for Kant outside of the context of concrete social relations with other moral agents. (shrink)

Kant’s metaphilosophy has three main parts: (1) an essentialist project (“What is philosophy?”); (2) a methodological project (“How do we do philosophy?”); and (3) a taxonomic project (“What are the different parts of philosophy, and how are they related?”). This paper focuses on the third project. In particular, it explores one of the most intriguing yet puzzling aspects of Kant’s philosophy, viz. the relationship between what Kant calls ‘pure’ philosophy vs. ‘applied’, ‘empirical’ or what we can broadly refer to as (...) ‘impure’ philosophy. (As we shall see, in order to be able to address this third project, we shall also need to examine the other two projects in detail.) My plan is as follows. First, I discuss four main areas of pure vs. impure philosophy: (i) ‘pure logic’ vs. ‘applied logic’; (ii) ‘rational psychology’ vs. ‘empirical psychology’; (iii) ‘pure metaphysics of nature’ vs. ‘physics’ and (iv) ‘pure morality’ or a ‘metaphysics of morals’ vs. ‘moral anthropology’, ‘practical anthropology’ or ‘applied moral philosophy’. Based on this, I identify four key differences between pure and impure philosophy. Second, I critically examine four different readings of Kant’s views about the status of ‘impure’ philosophy: (a) that it is not genuine philosophy; (b) that it is bad or inferior philosophy; (c) that it is instrumentally valuable; and (d) that it constitutes an indispensable part of Kant’s philosophy, both in a theoretical and practical sense. I argue that Kant is best interpreted as endorsing readings (c) and (d). Third, I offer some concluding remarks. (shrink)

Is there any interesting sense in which we can speak of an act as 'evil', in contrast to simply "morally bad' or "immoral"? In ordinary language, we typically judge actions as evil that somehow differ significantly, in terms of degree or intensity, from commonplace wrongdoing. If taken to an extreme, however, this view simply reduces the difference between evil and immoral acts to a mere quantitative analysis. At worst, it leads to a wholly trivial account of evil as just those (...) actions we tend to regard as "really bad". In this paper, I outline a distinctively Kantian theory of evil that instead defends a fundamental qualitative difference between evil and more ordinary immoral actions, locating the main distinction in terms of the structure of the agent's will itself Broadly understood, this strategy endorses a Kantian account of "evil as dehumanization" in which a "material" -- as opposed to purely "formal" -- difference exists between the respective maxims of the immoral and the evil agent. In such instances, unlike typical cases of Kantian immoral actions, direct violation of another person's humanity qua human somehow comprises a necessary part of the "material object" of an evil agent's will. In this paper, I attempt to synthesize the two most influential contemporary ethical approaches that appeal to moral intuitions, viz., Rawlsian reflective equilibrium and Audi’s moderate intuitionism. This paper has two parts. First, building upon the work of Audi and Gaut, I provide a more detailed and nuanced account of how these two approaches are compatible. Second, I show how this novel synthesis can both (1) fully address the main objections to reflective equilibrium, viz., that it provides neither necessary nor (...) sufficient conditions for the justification of our moral beliefs and (2) help ethical intuitionism to deal with the fundamental problem of peer disagreement over our basic moral intuitions. In doing so, I sketch out a novel and attractive diachronic way of thinking about peer disagreement more generally. (shrink)

*Honorable Mention for the 2024 American Association of Philosophy Teachers (AAPT) Lenssen Prize*: In recent years, ‘philosophy as a way of life’ [PWOL] courses have emerged as an exciting new pedagogical approach. I explain what a PWOL-course is. Next, I argue that the standard method for teaching such courses—what I call the ‘Smorgasbord Model’—presents us with a basic problem: viz., the challenge of how to enable students in the context of the modern university to truly experience what a PWOL even (...) is. I propose a solution to this problem by exploring a PWOL that most teachers and students alike already find themselves immersed in, what I describe as political liberalism applied to the university classroom context. I show how this overlooked fact not only offers us a novel resource for teaching PWOL-courses. It also helps philosophy teachers—in a meta-pedagogical sense—to become more self-reflective about and appreciative of our fundamental ethical commitments when teaching philosophy. (shrink)

In order to make some headway on the debate about whether Kant was a constructivist, nonconstructivist, or instead defends a hybrid view that somehow entirely sidesteps these categories, I attempt to clarify the terms of the debate more carefully than is usually done. First, I discuss the overall relationship between realism and constructivism. Second, I identify four main features of Kantian constructivism in general. Third, I examine three rival versions of metanormative Kantian constructivism, what I’ll call axiological, constitutivist, and rationalist (...) constructivist. I argue that Kant is best seen as a rationalist constructivist. I conclude by arguing that although it’s a constructivist view, this reading avoids the main pitfalls of traditional Kantian constructivism. In doing so, it helps us to achieve a satisfying rapprochement between constructivist and non-constructivist readings of Kant. (shrink)

El trabajo cuestiona críticamente cierta visión extrema y unilateral apreciable en Adorno y Horkheimer al juzgar la relación de la industria cultural con la música. Es cierto que hoy prácticamente toda actividad humana se encuentra condiciona¬da por el mercado y que la música no es una excepción. Ella también es portadora de valor de cambio que tiende a ser dominante en los marcos de la industrial cultural. Pero es plausible que dentro de las industrias culturales mismas se empezara a hacer (...) una distinción entre los bienes culturales producidos por razones meramente comerciales y aquellos producidos por razones más artísticas. Un público demandante de obras de valor artístico, aun cuando pueda ser minoritario y estar inmerso también él en el mercado, condiciona de cierta manera la propia producción cultural, o, al menos, un segmento de ella. Esta posibilidad real no era muy reconocida por los autores de la “La industria cultural”. Según su lógica, como nada puede sustraerse a la industria cultural y como ésta compulsa a la prevalencia del valor de cambio o comercial y a la casi supresión de cualquier otro valor, entonces el arte, el verdadero arte, terminaría por desaparecer, sucumbiendo ante una lógica no interesada en su conservación o crecimiento, sino sólo en la maximización de ganancias a toda costa. Los hechos han contradicho esta conclusión. La relación de la música con la industria cultural, igual que las monedas, tiene dos caras. No basta con reconocer sólo la parte negativa, la que busca alienar las obras con tal de convertirlas en sólo mercancías. Es imprescindible tomar en cuenta también la posibilidad más que comprobable de que piezas con excelente factura estética surjan también en los marcos de esta industria. El asunto radicaría en develar las condiciones que lo posibilitan. El mercado, si bien puede favorecer la generación de productos pseudoculturales de escaso o nulo valor artístico, también se constituye en la única vía, dentro de la sociedad de consumo, por medio de la cual lo genuinamente valioso se convierte en patrimonio común. In this paper, we analyze the origin of the links between global bioethics (which we differentiate from biomedical bioethics) and human rights. We understand that we are in a global civilizational crisis, whose roots extend to 1492 today, in which the modern-capitalist model used the discourse of human rights to justify its predatory technocracy. There are three theoretical assumptions that support our analysis: 1) The current conditions in which the technique shows its destructive power over nature (Anthropocene) indicate that none (...) of the ethical antecedents are applicable to such circumstances. In this new context, the kantian categorical imperative has been reconverted into a moral and political duty to not instrumentalize either human beings or nature. We call this new ethical consideration bioethics. 2) The current geopolitical composition of the world must be thought in terms of the global North and the global South, as two regions that are forged in the midst of important processes of globalization of the world-system, and whose main consequence lies in the absence of equity in the distribution of wealth and well-being between the two. 3) The current environmental crisis or climate change, the product of an economic model based on extractive technology, has become one of the most serious threats against human rights. The truth of a statement depends on the world in two ways: what the statement says is true if the world is as the statement says it is; on the other hand, what the expressions in the statement mean depends on what the world is like (for instance, on what conventions are in place). Each of these two kinds of dependence of truth on the world corresponds to one of the dimensions on the two-dimensional semantic framework, developed in the 1970’ (...) in the work of Evans, Kaplan, Kripke and Stalnaker. The introduction provides a systematic overview of the framework, the ideas of its earlier originators, recent developments and criticism. The post-Marxist stance against class politics unearths significant political demands often neglected by Marxism. However, in Ernesto Laclau and Chantal Mouffe’s approach, this step forward is followed by two steps back. They deny that class struggle against capitalist exploitation has any political significance for the masses or any essential link with the socialist-democratic project. But they do so at the cost of misrepresenting Marxian theory and underestimating the global phenomenon of labour exploitation. This faux pas is due to two (...) misconceptions at the core of the Laclau-Mouffean critique: an ambiguity in the use they make of the economic concept of surplus, and an incorrect identification of working-class and productive workers. With Laclau and Mouffe, I share the firm conviction in the necessity of a post-Marxian theory. Nevertheless, post-Marxism will be just as robust as our Marxist bedrocks. (shrink)

A filosofia da linguagem dedica-se ao estudo da linguagem natural. Não se dedica ao estudo de línguas particulares, tal como o português, o castelhano ou o inglês, mas sim ao estudo filosófico de características gerais da linguagem e da nossa capacidade e proficiência linguística enquanto seres humanos. A investigação do desenvolvimento da linguagem é uma tarefa a ser desenvolvida pela ciência – a paleontologia, a neurologia, etc. Mas a ciência ocupa-se de algo de que temos um conhecimento intuitivo prévio – (...) a linguagem natural. Ora, a filosofia da linguagem dedica-se em parte a tornar explícito o nosso conhecimento implícito da linguagem. Como tal, a filosofia da linguagem é uma disciplina central na filosofia. Este capítulo é uma introdução selectiva à filosofia da linguagem. A alternativa que se nos deparava era fazer uma breve apresentação de teorias do significado, da referência e da verdade, e ainda de alguns tópicos de pragmática, ou escolher um tópico em particular que é, tradicionalmente, o elegido nos cursos introdutórios à filosofia da linguagem. Este capítulo oferece assim uma introdução a alguns dos temas centrais e clássicos da filosofia da linguagem contemporânea. A maior parte do capítulo dedicar-se-á a teorias da referência, a de Frege e de Russell, e à sua crítica subsequente por filósofos como Saul Kripke. Isto poderia levar-nos a pensar que a filosofia da linguagem contemporânea continua, como era tradicional, focada simplificada da relação entre linguagem, mente e mundo. Nada podia estar mais longe da verdade, como se tornará claro. A grande alteração na perspectiva sobre o estudo da linguagem, que se deve a pessoas como Frege ou Russell, é que graças ao seu trabalho os filósofos passaram a reflectir sobre a contribuição semântica sistematicamente feita por diferentes categorias sintácticas nas diferentes construções frásicas em que possam ocorrer, por exemplo a de termos referenciais como os nomes próprios. A relação linguagem-mente-mundo continua a ser uma preocupação dos filósofos contemporâneos, mas de uma forma muito mais sofisticada, rigorosa e sistemática. Os filósofos preocupam-se agora, por exemplo, com as condições de verdade correctas de usos particulares de frases, com os estados de coisas reais ou possíveis que confeririam verdade ou falsidade às frases usadas, e com o valor cognitivo de distintos tipos de frases. Como indicaremos na última secção do capítulo, outros desenvolvimentos da filosofia da linguagem contemporânea dizem respeito àquilo que nós, enquanto seres humanos, conseguimos fazer por meio da linguagem, aos diferentes actos de fala possíveis, e aos diferentes níveis de significado que podemos comunicar por meio do uso de frases com um significado convencionalmente estabelecido. To reject skepticism and lay the foundation for the certainty of knowledge, Kant raised the question of how synthetic a priori proposition is possible. In his solution, the new content of knowledge comes from the syntheses of experience a posteriori, and the universal necessity of knowledge is guaranteed by it’s a priority. Under the influence of Kant, the concept of a priori and necessity has long been regarded as coextensive. But Saul Kripke believes that this will confuse different philosophical fields: (...) a priori is an epistemological concept, which involves the way or means of acquiring knowledge, and necessity is a metaphysical concept, which involves the possible ways or states of the world. The key point is that, on Kripke, there is no necessary connection between these two fields. He raised some famous examples of the necessary a posteriori. More remarkably, in his explanation of necessary a posteriori, although he did not clearly propose the distinction between epistemic possibility and metaphysical possibility, he had laid the foundation for this distinction. Furthermore, on Manuel Garcia-Carpintero and Josep Macia, when Kripke talks about necessary a posteriori by appealing to two relevant expressions, what he proposed can be taken as kind of ‘blueprint for 2-D accounts’. (Manuel Garcia-Carpintero and Josep Macia, 2006, p.2) There are different forms of two-dimensionalism in semantics. I will focus on David Chalmers’s epistemic version and Scott Soames’ criticism. With the framework of possible world semantics established by Kripke and others, David Chalmers’ epistemic two-dimensionalism deals with the relationship between epistemic and metaphysical modalities from a quite different perspective, and then gives an elegant definition to necessary a posteriori and other modal concepts. Scott Soames criticized two-dimensionalism based on Kripke's modal realism and essentialism, and developed Kripke's account of necessary a posteriori. But according to Chalmers, Soames also uses a two-dimensional system himself to analyze cases of the necessary a posteriori. In the first two part of this paper I will briefly introduce the epistemic two-dimensionalism and specify the similarities between Kripke-Soames and Chalmers when they interpret necessary a posteriori. In the third part I turn to their difference by the analysis of relationship between epistemic possibility and metaphysical possibility which is the key issue for illuminating necessary a posteriori. Los estudiantes de la Facultad de Ciencias Económicas y de Administración de la Universidad de la República deben realizar, como trabajo final de carrera, una investigación o ensayo monográfico en un área de su interés, tutorados por un docente universitario o un investigador de reconocida trayectoria. Un gran número de estos trabajos monográficos han hecho un aporte valioso al conocimiento pero, lamentablemente, la poca difusión de éstos hace que ese conocimiento termine olvidado en los fondos de la biblioteca de la (...) Facultad, entre cientos de producciones monográficas. Se pretende en este libro, mostrar los aportes que se han generado en el área tanto de Economía de la Cultura como de Gestión de Organizaciones Culturales. Varias de las monografías fueron realizadas en la línea de investigación Costos y Gestión de Organizaciones Culturales, la cual coordino. Otros fueron realizados con antelación, como los trabajos tutorados por el referente de la Economía de la Cultura en Uruguay, el hoy fallecido Luis Stolovich. También se incluyen dos trabajos monográficos tutorados por el Dr Gustavo Buquet, quien siempre está presente a la hora de crear investigación de calidad en Economía de la Cultura. Como cada trabajo supera el centenar de páginas, no es posible publicarlos completamente, por lo que para este libro se hicieron resúmenes de esos trabajos, intentando adecuar la terminología y quitándoles el formato estrictamente científico –poco amigable para un no especialista-, de forma tal que su lectura sea accesible al público en general. Se resumieron ocho, clasificados en tres capítulos: Patrimonio, Artes Escénicas e Industria Cultural. El capítulo de Patrimonio comienza con un trabajo realizado por las Economistas Fernanda Arezo y Verónica Pereyra, titulado “Museos y Ciudadanos, el comportamiento del consumidor”, tutorado por Raúl Ramírez y por mí. Este estudio tuvo como centro explicar la modalidad de conducta de consumo del visitante montevideano hacia tres importantes instituciones museísticas como lo son el Museo del Cabildo, el Museo del Carnaval y el Museo de Historia del Arte. El objetivo del trabajo es estimar la demanda y obtener un indicador de la propensión a pagar por el consumo de dichos museos. El segundo trabajo, titulado “Disposición a pagar por la restauración de la Puerta de la Ciudadela”, fue realizado por las Contadoras Beatriz Torres, María Elena Olarán y María Carolina Duarte, y tutorado en forma conjunta por el Phd. Juan José Goyeneche y quien les escribe. En este trabajo se realiza una valoración contingente para medir la disposición a pagar por la restauración de la “Puerta de la Ciudadela”, un monumento fundamental de identidad montevideana. El capítulo de Patrimonio finaliza con un trabajo realizado por las Economistas Malena Rodríguez y María de la Paz Besada y tutorado por el Ec. Luis Stolovich. El mismo se denomina “El arte uruguayo: un estudio sobre el mercado y la pintura como alternativa de inversión” y explora el mercado de arte uruguayo, analizando la rentabilidad de la inversión en pintura uruguaya. Tratan la rentabilidad de la inversión para tres casos específicos: las obras vendidas por el Banco Comercial en su proceso de recuperación de activos, un portafolio de obras de Pedro Figari y otro de Joaquín Torres García. En cuanto al segundo capítulo, Artes Escénicas, comienza con un trabajo realizado para la obtención del título de Contador Público realizado por Pamela Cambeiro, Martín Cami e Ignacio Mouradián. Se denomina “La gestión de teatros. Caso de estudio: Aplicación del Cuadro de Mando Integral al Teatro Solís” y trata sobre la identificación de indicadores que faciliten las tareas de gestión para la dirección del Teatro. Luego se presenta un trabajo realizado por las Economistas Tania Cruz y Natalia Nollenberger titulado “Análisis económico del teatro independiente en Montevideo: una aproximación al problema de la fatalidad de los costos”. Este trabajo, también tutorado por el Ec. Luis Stolovich, muestra un exhaustivo análisis del teatro independiente montevideano identificando los problemas económicos que afectan al sector. El capítulo de Industria Cultural incluye tres trabajos. El primero, fue realizado por el Economista Diego Traverso y tutorado por el Dr. Gustavo Buquet, y su título es “Análisis de competitividad del sector exportador de Productoras Audiovisuales Publicitarias en Uruguay”. El sector audiovisual publicitario es un sector dinámico que se ha internacionalizado tempranamente y que generó divisas para el país del orden de los US$ 24 millones durante el año 2005 por concepto de exportaciones. En este trabajo se caracteriza al sector audiovisual publicitario en Uruguay y se analiza las ventajas competitivas que posee frente a sus principales competidores extranjeros. El segundo trabajo fue realizado por las Contadoras Natalia Rivera, Antonella Triay y María Eugenia Triay y se denomina “Gestión aplicada a las empresas radiales”. En este se identifican el sector radial, su proceso productivo y la complejidad al definir al “cliente”. Se proponen una serie de indicadores con el doble objetivo de medir el desempeño de la empresa y proveer incentivos a su organización. Finalmente, el último trabajo monográfico, fue una investigación interdisciplinaria, que sirvió simultáneamente para obtener el título de Licenciado en Economía a Ernesto Pienika y el de Licenciado en Administración a Nicolás Cohnheim y a Damián Geinsinger. Este trabajo, tutorado por el Dr. Gustavo Buquet y el Cr. Cecilio García de título “Impactos de las nuevas tecnologías en la .industria musical”, muestra cuáles son los principales impactos en esa industria que las nuevas tecnologías han provocado y cuáles son las posibles estrategias para adaptarse a estos cambios, así como los nuevos modelos de negocio. Espero que este libro sea el primero de una larga lista. Las áreas de Economía de la Cultura y Gestión de Organizaciones Culturales son disciplinas jóvenes que necesitan seguir creciendo. La investigación realizada por trabajos monográficos de fin de carrera en estas áreas, será siempre bienvenida. (shrink)

El trabajo consiste en una elucidación de los elementos que conforman el concepto de pena natural (poena naturalis) en el Derecho penal. Se puede caracterizar la pena natural como el daño o sufrimiento que recae sobre el autor de un delito, producto de la comisión del mismo, que debe ser descontado de la pena legal que ha de aplicársele. Si bien existe un mínimo acuerdo sobre esto, tanto en la jurisprudencia como en la doctrina penal se observan serios desacuerdos acerca (...) de los requisitos que se deben cumplir para reconocer que se está frente a una pena natural. Para elucidar los elementos, se utilizará el constructivismo conceptual de Ronald Dworkin, a fin de describir el desacuerdo y sus implicancias, reconocer los elementos principales de la pena natural y justificarlos bajo su mejor luz moral. ABSTRACT This study focuses on the clarification of the conceptual elements of poena naturalis in criminal law settings. The poena naturalis is the damage or suffering that falls on the convict for its commission. This damage must be deducted from the poena forensis to be applied. Although there is a minimum agreement about the concept of poena naturalis, in the jurisprudence and among legal scholars, there are serious disagreements about the elements of poena naturalis. To elucidate the elements, I will adopt Ronald Dworkin’s conceptual constructivism to describe the disagreement and its implications. At last, I will justify the main elements of the poena naturalis by their best moral light. (shrink)

Temporal ontology is the philosophical debate on the existence of the past and the future. It features a three-way confrontation between supporters of presentism (the present exists, the past and the future do not), pastism (the past and the present exist, the future does not), and eternalism (the past, the present, and the future all exist). Most philosophers engaged in this debate believe that presentism is much more in agreement with common sense than the rival views; moreover, most of them (...) believe that being in agreement with common sense is epistemically valuable for a philosophical view. We studied experimentally non-experts’ ideas pertaining to the domain of temporal ontology, i.e., as we called it, common-sense temporal ontology, focusing on the Italian population. We found that a non-overwhelming majority of participants (~64%) favoured presentism, while two significant minorities favoured pastism (~19%) and eternalism (~17%). We think that our findings provide some support, albeit weaker than expected, for the view that presentism is more in agreement with common sense than the rival positions. (shrink)

La renta básica se nos presenta en la obra de Philippe van Parijs como una propuesta política filosóficamente argumentada, de modo tal que convencerá tanto al teórico de la justicia como al ciudadano que votará su implantación. En este artículo analizamos la argumentación de van Parijs mostrando cómo la efectividad política de sus tesis sólo se sostiene a costa de reducir el debate sobre la renta básica a los términos de su propia concepción de la ética. Ponemos en duda, por (...) nuestra parte, el alcance de esta reducción sobre un doble plano: diluye por completo la dimensión prudencial de toda argumentación política, y no deja más alternativa que la educación sentimental para quienes no se dejen convencer por el equilibrio reflexivo. Este artículo estudia la justificación normativa de la adopción de los ensayos clínicos aleatorizados por parte de las autoridades sanitarias británicas como estándar metodológico en 1946. A partir de un análisis de los distintos intereses de los participantes en el proceso (pacientes, médicos, farmacéuticas y el propio Estado) argumentamos que la aleatorización se adoptó como mecanismo de asignación imparcial de tratamientos, aunque sus propiedades estadísticas no fueran bien comprendidas. Tal justificación permanece aún vigente.

This essay explores the speech act of dogwhistling (sometimes referred to as ‘using coded language’). Dogwhistles may be overt or covert, and within each of these categories may be intentional or unintentional. Dogwhistles are a powerful form of political speech, allowing people to be manipulated in ways they would resist if the manipulation was carried outmore openly—often drawing on racist attitudes that are consciously rejected. If philosophers focus only on content expressed or otherwise consciously conveyed they may miss what is (...) most powerful and pernicious in the speech of political culture. This essay is a call to start paying attention to these more covert speech acts, and a first attempt at beginning to theorize them. It argues that dogwhistles present a complex and interesting case for the philosopher of language, and explores their implications for democratic politics. (shrink)

The Dead Past Growing Block theory of time—DPGB-theory—is the metaphysical view that the past and the present tenselessly exist, whereas the future does not, and that only the present hosts mentality, whereas the past lacks it and is, in this sense, dead. One main reason in favour of this view is that it is immune to the now-now objection or epistemic objection (which aims at undermining the certainty, within an A-theoretical universe, of being currently experiencing the objective present time). In (...) this paper, I examine the additional arguments offered by P. Forrest and G. A. Forbes to back the DPGB-theory and show that they do not work. I also examine a proposal to rescue the DPGB-theory suggested by an anonymous reviewer for this journal and argue that it does not work either. Moreover, in line with D. Braddon-Mitchell and against Forbes, I argue that the DPGB-theory is indeed committed to the existence of zombies in the past. Being ad hoc and burdened by a very odd and counterintuitive ontological commitment, the DPGB-theory turns out to be rather unpalatable. (shrink)

I present a novel position vis-à-vis the views in the Latin American philosophy literature regarding whether subjects more aptly use "Hispanic" or "Latinx" to refer to Hispanic- or-Latinx people. To this end, I will argue (C) the term "Afro-Latinx" is more apt than "Hispanic" or "Latinx" in a significant number of cases. This conclusion is based on three premises. The first premise (P1) is that use of "Afro-Latinx" provides subjects with understanding of how certain events depend on anti-Black racism, US (...) society's racially unjust structure and US colonial policy. The second premise (P2) is that that neither the term "Hispanic" nor the term "Latinx" provide subjects with this understanding of how certain events depend on anti-Black racism, US society's racially unjust structure and US colonial policy. The third premise (P3) is that the term "Afro-Latinx" provides subjects with more understanding of these events than the terms, "Hispanic" and "Latinx.” I present three cases which feature the experiences of Afro-Dominican people. The 1992 murder of Dominican man Kiko García by New York Police officer O’Keefe is first case. The second case is the Washington Heights Uprising that ensued Kiko García’ murder. An instance where a nightclub bouncer in the Dominican Republic denies a Dominican women entry because of her hair texture composes the third case. (shrink)

Our purpose is to describe the application of legitimate defense in so-called non-confrontational situations. To do this, we will conceptualize gender violence as that which against women, due to their condition as such, and we will describe the absence by the courts in the identification of this problem. Second, we will analyze the reception of Argentine and international legislation on the treatment of gender violence and the recommendations and criteria to take into account when interpreting and applying criminal law. Finally, (...) we will present the treatment of legitimate defense in contexts of gender violence, analyzing each of its elements. Our conclusions will focus on the need to address situations of gender violence based on international regulations for the application of legitimate defense in non-confrontational situations. La mal llamada “Conquista del Desierto” constituyó una serie de campañas militares ocurridas en el actual territorio patagónico argentino entre los años 1878 y 1885 cuyo resultado fue el asesinato, la violación y sometimiento a la esclavitud de diversos pueblos y comunidades indígenas. Este no fue un caso aislado, sino que se suma a una serie de ataques sistemáticos que han sufrido los indígenas en la Argentina. En los últimos años, a raíz del reclamo y las luchas de los pueblos (...) y comunidades indígenas, así como también de las organizaciones de derechos humanos, se han comenzado a juzgar algunos de estos hechos. En particular, la Masacre de Napalpí (1924) y la Masacre de La Bomba (1947) fueron los primeros que lograron respuestas judiciales favorables. En ambos se determinó que el accionar estatal era constitutivo de un genocidio y, por lo tanto, se debía resarcir a las comunidades actuales. Ahora bien, la Campaña del Desierto, al día de hoy, no tiene respuesta por parte del Estado. Teniendo presente este panorama, nuestro objetivo en este trabajo es reconstruir los diferentes problemas que enfrenta la posibilidad del reclamo judicial. Para ello, comenzaremos describiendo en qué consistió la Campaña del Desierto. Luego, explicaremos la noción de genocidio aplicado a hechos de injusticias históricas. Como tercer paso, reconstruiremos los casos jurisprudenciales que se han preocupado por genocidios indígenas ocurridos en el pasado. Con este panorama revelado, nos enfocaremos en los diferentes problemas jurídicos y políticos que surgen en los reclamos de justicia. (shrink)

In a series of recent papers Francesco Orilia has presented an argument for the moral desirability of presentism. It goes, in brief, as follows: since the existence of painful events is morally undesirable, presentism, which denies that past painful events (tenselessly) exist, is morally more desirable than non-presentism, which instead affirms that past painful events (tenselessly) exist. An objection against this argument, which has already been taken into consideration by Orilia, is the ugly history objection or radical objection: what really (...) matters in the moral appraisal of a world is the history of it, and since the presentist and the non-presentist versions of our world share the same ugly history, they are morally on a par. This paper aims at corroborating this objection and defending it from Orilia’s criticisms. This will be done by bringing into play various thought experiments and a distinction between relevance (of an event or a fact about the occurrence of an event) to the moral evaluation of a world and moral (and psychological) involvement (in an event or in a fact about the occurrence of an event). Presentism is, roughly, the ontological view that only the present exists. Among the philosophers engaged in the metaphysics of time there is wide agreement that presentism is intuitive (or commonsensical) and that its intuitiveness counts as evidence in its favour. My contribution has two purposes: first, defending the view that presentism is intuitive from some recent criticisms; second, putting forth a genealogical (or debunking) argument aimed at depriving presentism’s intuitiveness of the evidential value commonly granted to it.

In recent work, Williamson has defended a suggestive account of assertion. Williamson claims that the following norm or rule (the knowledge rule) is constitutive of assertion, and individuates it: (KR) One must ((assert p) only if one knows p) Williamson is not directly concerned with the semantics of assertion-markers, although he assumes that his view has implications for such an undertaking; he says: “in natural languages, the default use of declarative sentences is to make assertions” (op. cit., 258). In this (...) paper I will explore Williamson’s view from this perspective, i.e., in the light of issues regarding the semantics of assertion-markers. I will end up propounding a slightly different account, on which, rather than KR, what is constitutive and individuating of assertion is an audience-involving transmission of knowledge rule: (TKR) One must ((assert p) only if one’s audience comes thereby to be in a position to know p) I will argue that TKR, of which KR is an illocutionary consequence (but not the other way around), has all the virtues that Williamson claims for his account and no new defect. I defend a Deferred Ostension view of quotation, on which quotation-marks are the linguistic bearers of reference, functioning like a demonstrative; the quoted material merely plays the role of a demonstratum. On this view, the quoted material works like Nunberg’s indexes in his account of deferred ostensión in general. The referent is obtained through some contextually suggested relation; in the default case the relation will be … instantiates the linguistic type __, but there are other possibilities. In this way, the (...) deferred ostension view deals with a problem I pointed out for the identity proposal in my earlier work, that we do not merely refer with quotations to expression-types, but also to other entities related in some way to the relevant token we use: features exhibited by the token distinct from those constituting its linguistic type, features exhibited by other tokens of the same type but not by the one actually used (as when, by using a graphic token, we refer to its phonetic type), or even other related tokens (see the examples on p. 261 of García-Carpintero 1994). There is a particular ressonance between the thinking of Walter Benjamin and that of the German jurist Carl Schmitt, including the fact that both analyse the 16th and 17th centuries in order to understand the 20th. Regarding this fact, the article attempts to clarify some themes that lead Schmitt’s work, i.e that of State of Exception, that of theologization of politics, the critique of parliamentarism as support of the Modern State, the tension between democracy and dictatorship, to explain how the (...) dialog between the two thinkers occurs, seeking thus for a better understanding of key works of Benjamin, specially The Origin of German Tragic Drama. I argue racial injustice undermines the reliability of news source reports in the information domain of racial injustice. I argue that this in turn undermines subjects’ doxastic justification in inferences they base on these news sources in the racial injustice information domain. I explain that racial injustice does this undermining through the effect of racial prejudice on news organizations’ members and the effect of society's racially unjust structure on non-dominant racial group-controlled news sources.

We provide here irrefutable facts that prove the falsehood of the claims published in [1] by Dehmer and Mowshowitz (DM) against our paper published in [2]. We first prove that Dehmer’s definition of node probability [3] is flawed. In addition, we show that it was not Dehmer in [3] who proposed this definition for the first time. We continue by proving how the use of Dehmer’s definition does not reveal all the physico-mathematical richness of the walk entropy of graphs. Finally, (...) we show a few facts about the failure of DM themselves to cite properly the relevant literature in their field. We also show here how the Editors of Complexity have failed to manage the publication of [1] in an appropriate way according to the accepted guidelines given in the Code of Conduct and Best Practice Guidelines for Journal Editors, published by the Committee on Publication Ethics (COPE). As touch remains commonly defined by the closeness it physically implies and it rhetorically evokes, the mere notion of distant touch and of distal haptic perception seems peculiar. But Aristotle’s perspective, which I wish to take as a point of departure, is firm: we perceive the objects of touch, the hot and the cold, the hard and the soft, the curved and the sharp, through other things: δι' ἑτέρων. In this article, I would like to explore this ἕτερος by showing (...) how the otherness of perception always implies an intermediary, a middle point (μέσος), i.e. an other not so other, an other that is able to translate the much more distant otherness of the perceived object. To explore these forgotten layers of alterity that fall into what we commonly conceive of as the impalpable emptiness of distance, I propose to study the idea of distant touch from the perspective of phenomenological aesthetics. In order to do so, I will first examine some aspects of the Husserlian account of perception and will then focus on the phenomenology of distant touch in Alejandra Costamagna’s novel El Sistema del Tacto [The System of Touch] (2018). El artículo se propone elucidar el papel que juegan los usos de “raza” en los escritos de Nietzsche, situándolos e interpretándolos en conjunto con el léxico de transformación del ser humano y de su crítica de la cultura. Para ello, se estudia su empleo junto a otros conceptos fronterizos e ideas análogas como el tratamiento de la cuestión judía, su crítica del nacionalismo, la figura de los buenos europeos, la metáfora de la bestia rubia, los tipos humanos y el pensamiento (...) de la cría. Se concluye que “raza” posee un indudable carácter fisiológico y evolutivo, pero a través del proceso de incorporación (Einverleibung), el ámbito de la cultura y la moral intervienen de manera fundamental en su conformación, y como concepto, forma parte del mismo proyecto de transvaloración de los valores, la reforma de la cultura y de la humanidad. One of the hottest philosophical debates in recent years concerns the nature of the semantics/pragmatics divide. Some writers have expressed the reserve that this might be merely terminological, but in my view it ultimately concerns a substantive issue with empirical implications: the scope and limits of a serious scientific undertaking, formal semantics. In this critical note I discuss two arguments by Recanati: his main methodological argument --viz. that the contents posited by what he calls 'literalists' play no relevant role in (...) communication--, and some phenomenological considerations regarding the "Availability Principle" that he appeals to in order to buttress that main argument. /// Uno de los más encarnizados debates filosóficos recientes atañe a la naturaleza de la distinción entre semántica y pragmática. Aunque algunos autores han expresado reservas en el sentido de que èste pudiera ser sólo terminológico, en mi opinión tiene que ver con una cuestión sustantiva con implicaciones empíricas: el alcance y los límites de una empresa científica seria, la semántica formal. In Charles Mills’ essay, “White Ignorance,” and his trail-blazing monograph, The Racial Contract, he developed a view of how Whiteness or anti-Black-Indigenous-and-Latinx racism causes individuals to hold false beliefs or lack beliefs about racial injustice in particular and the world in general. I will defend a novel exegetical claim that Mills’ view is part of a more general view regarding how racial injustice can affect a subject’s epistemic standing such as whether they are justified in a belief and whether their (...) degree of confidence in the belief is rational given their evidence. Then, in light of this novel exegetical claim, I show how this interpretation of Mills’ view that racial injustice causes ignorance relates to how epistemically justified philosophers and social scientists are in the views that dominate their respective scholarly literature. L'ontologia temporale è la riflessione sullo statuto ontologico delle entità meramente passate o future. In questo contributo intendo chiarire il significato di questa questione, presentare le principali opzioni teoriche che si delineano rispetto ad essa e, concentrandomi sulle due principali teorie contendenti, B-eternismo e presentismo, illustrare gli argomenti più rilevanti formulati a favore dell'una e dell'altra.

I argue that Bartolomé de las Casas and Juan Ginés de Sepúlveda differed in their conclusions regarding the status of Indigenous persons at least partly because las Casas had significant, yet incomplete, understanding of Indigenous persons, culture and societies and Sepúlveda had mere knowledge of them. To this end, I show that the epistemic state of understanding explains why Las Casas properly concluded that Indigenous persons deserve the same moral status afforded to Europeans. And I show how las Casas’ understanding (...) of Indigenous persons, culture and societies related to what he got wrong about Indigenous persons. (shrink)

In the present work I am interested in addressing a specific aspect within the conceptual problem that poena naturalis implies. In other words, here I will answer the question about what is the poena naturalis. We can be recognized three theories: one that affirms that the poena naturalis is a compensation for culpability, another according to which the poena naturalis is the product of clemency or compassion, and the last that defends that the principles of legality, proportionality and rationality allow (...) justifying the poena naturalis. I will stop at each one of them in order to carry out a critical examination that will allow me to conclude which is the conception that best supports natural punishment. (shrink)

Presentism is the view that only present temporal entities (tenselessly) exist. A widely-discussed problem for presentism concerns causation and, more specifically, the supposed cross-temporally relational character of it. I think that the best reply to this problem can already be found in the literature on temporal ontology: it consists, roughly, in showing that (at least) some of the main approaches to causation can be rephrased so as to avoid commitment to any cross-temporal relation, including the causal relation itself. The main (...) purpose of this paper is to extend this reply to the process view, an approach to causation that has not been considered within this debate until now. I shall do this by taking into account Dowe’s conserved quantity theory—a recent and prominent theory of this sort— and employing it as a proxy for the other major process theories of causation. In dealing with Dowe’s process theory of causation, however, two additional problems must be faced: one concerns the four-dimensional spacetime framework on which its formulation relies; the other concerns the very notion of causal process (and the companion notion of causal interaction). While the presentistic account of Dowe’s theory (and, virtually, of the process view of causation in general) put forth in this paper is intended primarily as a contribution to the mentioned paraphrase- based enterprise of reconciliation between presentism and causation, I shall also offer some reasons for presentists to prefer the process view of causation to the other views of causation that have already been reconciled with presentism. La doctrina establecida por la Corte Suprema de Justicia de la Argentina en relación a los crímenes de lesa humanidad cometidos durante la última dictadura militar, expresamente declaraba la obligación del Estado de investigar y juzgar a los responsables de su comisión. La Corte no sólo caracterizó dichos delitos, sino que también estableció que no eran susceptibles de amnistía, indulto, ni prescripción. Pero, en el año 2017 dictó el fallo “Muiña” donde, por voto mayoritario, decidió otorgarle el beneficio del “2 (...) por 1” a un condenado por dichos delitos. La consecuencia fue su inmediata libertad por el vencimiento de la condena. La respuesta de la sociedad fue clara. Con diversas manifestaciones, la sociedad civil, las instituciones y las personalidades públicas se declararon en contra de la sentencia. Más aún, del voto de los mismos jueces se observan expresiones que denotan un gran pesar a la hora de tomar la decisión. Más precisamente, sostenían estar ante un dilema. En este trabajo, lejos de realizar un análisis de la interpretación jurídica que se efectuó en la sentencia, se propone trabajar sobre el concepto de dilema y la posibilidad de aplicación en el presente caso. La finalidad concreta es indagar si se está ante un dilema y en su caso si los jueces utilizan este concepto como un arma argumentativa para lograr adhesión o compasión de la opinión pública. En este sentido, se comenzará relatando el marco jurídico del fallo, donde se describirá la historia judicial de Muiña y los argumentos dados por el voto mayoritario y el minoritario de la Corte. Luego, se realizará un análisis del concepto de dilema, para reconstruirlo sobre la base de dos grandes posturas: Una lógica conceptual y otra fenomenológica. Posteriormente, se realizará un examen de la dimensión institucional del derecho y la moralidad judicial, para - finalmente - poder intentar responder si se está efectivamente ante un dilema. Malem Seña in “¿Puede las malas personas ser buenos jueces?” analyzed the judicial morality. At first time from a historical analysis, the judges were not required to base their judgments, because they were the mirror of legitimacy and morality of their decisions. With the advent of rationalism and modern State, the sentences should be the foundation. The situation that put the judge person in the background. In this situation, the answer to the question posed in the job would be: "Yes, (...) bad people can be good judges", answer hardly accepted by all. Malem Seña, far from giving a definite answer, ends his work with the insinuation that judges should maintain an image of morality, rather than being morally unimpeachable agents. This situation raises questions about different dimensions of analysis that have been shelved, and in particular try to analyze why this importance takes the image of morality. To do this, from the perspective of the concepts of Slavoj Žižek‘s ideology and fantasy, it will attempt to reach some responses or generate argumentative lines about the importance of the image of morality on morality itself. There is a close relationship between education and citizenship. Liberal political theorists tend to spend much of their work justifying the role of educational institutions in political communities. However, the development of these proposals is usually thought for subjects who do not have disabilities, arbitrarily excluding a significant proportion of society. This not only happens at an educational level, it is replicated in various areas of social life. In this sense, in the present work I am going to propose that (...) the adequacy approach proposed by Debra Satz is extremely valuable to think about the educational equity of people with disabilities. The choice is not accidental or arbitrary. Satz is a renowned philosopher whose interest in education and its importance in forming citizens for diverse and plural societies. To do this, I will begin by presenting three possible models of special education: the special school, integration and inclusion. Then the two paradigms that prevail in the characterization of disability will be addressed: the social model and the medical model. Instead, I will reconstruct the third proposal elaborated by Satz in order to evaluate with which inclusive education model and disability paradigm it is compatible and why it is presented as a valuable proposal in this field. El presente artículo tiene como objeto llevar a cabo un estudio pragmático y analítico sobre la acción de valoración, el valor y los valores a la luz de la ciencia semiótica y de la ciencia cibernética. Por ello, se desarrollará un proceso axiológico que ilustre cómo sucede el ingreso, la transición y la salida de códigos morales en función de un esquema cognitivo. Así pues, el proceso axiológico se postula, primero, en fundamento de tres sistemas: de mentalidad, de valores y (...) de biomoralidad y, segundo, conforme a la teoría de la información y de la teoría general de sistemas. The study of complex systems, although an interdisciplinary endeavor, it is considered as an integrating part of physical sciences. Contrary to the historical fact that the eld is already mature, it still lacks a clear and unambiguous denition of its main object of study. Here, I propose a denition of complex systems based on the conceptual clarications made by Edgar Morin about the bidirectional non-separability of parts and whole produced by the nature of interactions. The concept to which I arrived (...) here is clear, not circular, neither too cryptic nor to explicit, and does not include any accompanying features of the own system dened. It allows, as shown in the paper, to derive some of the main properties that such systems must have as well as to propose its mathematical formalization. (shrink)

The article analyses the close link between perspectivism, genealogy, and physiology in Nietzsche’s philosophy. The cardinal thesis is that the point of view of value is more fundamental than that of truth. The genealogical method enables the study of the conditions of conservation and growth of points of view and values, following the conductive thread of the body, with the aim of creating new springs of meaning and leaving nihilism behind. Special attention is paid to the tension between dogmatism and (...) relativism. Lastly, I present Nietzsche's notion of “breeding” (Züchtung), which enables a radical questioning of culture and highlights the physiological character of morals.
